New Zealand Memorial Climb – Event Terms and Conditions
Organised by Fireup Events Limited
By registering to participate in the New Zealand Memorial Climb, you acknowledge and agree to the following terms and conditions:
1. Eligibility to Participate
1.1 You confirm that, at the time of registration, you are an active operational member of a recognised fire or emergency service. This includes:
- Paid or volunteer firefighters of Fire and Emergency New Zealand (FENZ)
- Personnel from international fire and emergency service authorities, including municipal, state, or national firefighting agencies
- Airport rescue and fire services, both domestic and international
- Industrial, private, or site-based firefighting units, such as Waihi Gold Mines Rescue or other organisations recognised as legitimate emergency fire response services in their jurisdiction
1.2 Fireup Events Limited reserves the right to request verification of your operational status at any time before or during the event.
2. Medical Fitness and Readiness
2.1 By registering, you declare that you are medically fit and physically capable of participating in the event, including climbing the internal stairwell of the Sky Tower in Auckland.
2.2 You confirm that you are not on any form of medical leave, including:
- General medical leave under medical advice
- ACC medical leave (New Zealand)
- Equivalent forms of medical leave from your local or national healthcare provider (for international attendees)
2.3 You accept responsibility for your personal health and wellbeing and agree to consult a healthcare provider prior to the event if you are unsure of your fitness.
2.4 Fireup Events Limited reserves the right to review all event registrations, and if concerns arise about your declaration of fitness or medical readiness, you may be requested to obtain a written declaration from a licensed healthcare provider confirming your ability to participate safely.
2.5 As part of Fireup Events Limited’s safety procedures, all event registrations are reviewed by a licensed and registered medical professional engaged by the event.
2.6 While Fireup Events Limited does not collect or store any personal health information as part of the registration process—in accordance with the New Zealand Privacy Act 2020—any general comments or notes you submit during registration regarding your health may be flagged. In such cases, further follow-up or clarification may be required to ensure your safe participation.
3. Check-In Process
3.1 All participants are required to complete the official check-in process, typically held on the morning of the event. The exact time and location of check-in will be confirmed by electronic communication in the lead-up to the event.
3.2 Each participant must check in individually at the designated check-in desk. For health and safety compliance, brigade members may not check in on behalf of others.
3.3 Failure to complete check-in in person may result in the participant being refused access to the event without refund or compensation.
4. Merchandise Collection
4.1 Participants are required to collect their merchandise items prior to participating in the event.
4.2 If merchandise is not collected during the designated pick-up time, Fireup Events Limited accepts no liability for any costs associated with transporting merchandise to the registered participant’s address.
4.3 Shipping and handling fees may be required upfront prior to the dispatch of any uncollected merchandise.
5. BA Set Allocation and Responsibility
5.1 Breathing Apparatus (BA) sets are issued on a first-in, first-served basis at the designated collection point.
5.2 By registering for a BA set, you accept full liability for the use, safekeeping, and timely return of the equipment.
5.3 Failure to return the equipment in a timely manner or loss/damage of the BA set may result in replacement costs being invoiced to the participant.
6. Code of Conduct
6.1 Participants must comply with all directions and instructions issued by:
- Fireup Events Limited staff, volunteers, and contractors
- SkyCity Auckland staff and security personnel
6.2 Respectful and safe conduct is required at all times. Failure to comply may result in removal from the event without refund.
7. Drug and Alcohol Policy
7.1 This is a zero-tolerance drug and alcohol event. Any participant suspected or found to be under the influence of any intoxicating substance will be immediately removed from the event. No refund will be provided.
7.2 The premises of SkyCity Auckland and surrounding areas within Auckland’s central business district operate under a 24/7 Alcohol Ban Bylaw, enforced by Auckland Council under the Auckland Council Alcohol Control Bylaw 2014.
7.3 Open or consumed alcohol outside of licensed premises may result in police fines or other enforcement action.
7.4 Fireup Events Limited is indemnified and accepts no responsibility for any legal or regulatory actions resulting from participant breaches of this bylaw.
8. Event Dress Code
8.1 This event is held in formal alliance and partnership with Fire and Emergency New Zealand. While it is privately operated by Fireup Events Limited, participants are required to wear official Level 2 firefighting gear (or internationally recognised equivalent) to participate in the climb.
8.2 Casual clothing or non-uniformed attire will not be permitted for participation in the climb.
9. Participant Waiver and Indemnity
9.1 By completing the event registration process, you acknowledge and agree to participate in the New Zealand Memorial Climb at your own risk.
9.2 To the maximum extent permitted by New Zealand law, you hereby release, hold harmless, and indemnify Fireup Events Limited, its directors, officers, employees, agents, volunteers, medical providers, sponsors, contractors, and affiliates (together, the “Indemnified Parties”) from and against any and all claims, demands, proceedings, losses, damages, liabilities, costs (including legal costs on a solicitor-client basis), or expenses arising directly or indirectly from:
- Your attendance or participation in the event;
- Any breach by you of these terms and conditions;
- Any act or omission by you which results in damage to property or injury to any person, including yourself.
9.3 This indemnity applies notwithstanding that any claim, loss, or liability may have been contributed to or caused by the negligence of one or more of the Indemnified Parties.
9.4 This clause is enforceable under the Contract and Commercial Law Act 2017, and interpreted in accordance with applicable rights under the Consumer Guarantees Act 1993 and the Health and Safety at Work Act 2015.
